Can You Get Married on a Tourist Visa in Australia?

Yes. You can legally get married in Australia while on a tourist visa.

There are:

  • no residency requirements
  • no requirement to be an Australian citizen
  • no restriction based on your nationality or gender

This applies equally to LGBTQ+ couples.

Is Same-Sex Marriage Legal for Visitors?

Yes. Same-sex marriage is fully legal in Australia, and the law applies equally to international couples.

As long as you meet the legal requirements, your marriage will be:

  • legally valid in Australia
  • treated the same as any other marriage

What Are the Legal Requirements?

To get married in Australia on a tourist visa, you must:

  1. Lodge a Notice of Intended Marriage (NOIM)
  • must be submitted to an authorised marriage celebrant at least 1 month before your wedding date
  • can be completed and witnessed overseas

  1. Provide Identification

Usually:

  • passports for both partners
  • or birth certificates and driver licences (photo ID)
  • divorce or death certificates (if relevant)

  1. Use an Authorised Celebrant

Your ceremony must be conducted by a registered celebrant.

  1. Have Two Witnesses
  • must be over 18
  • can be friends, family, or organised locally (I can provide these, if you need me to)

Timing Is Crucial

The biggest factor when planning from overseas is timing.

  • you must give at least 1 month’s notice to the celebrant
  • many couples allow 2–3 months, to be safe
  • documents should be prepared well in advance

Last-minute weddings are generally not possible unless special circumstances apply.

Will Your Marriage Be Recognised in Your Home Country?

This depends on your country of residence.

  • if your country recognises same-sex marriage → your marriage is usually recognised
  • if not → it may not be legally recognised there

This is especially important for:

  • immigration
  • legal rights
  • name changes

Does Marriage Give You Residency in Australia?

No – getting married in Australia does not automatically grant a visa or residency.

If you plan to stay in Australia:

  • you’ll need to apply for a partner visa separately
