Is Same-Sex Marriage Legal in Australia? (2026 Guide for LGBTQ+ Couples)

Learn your rights, legal requirements, and what LGBTQ+ couples need to know before getting married.

If you’re planning a wedding in Australia – or considering travelling here to get married – one of the first questions you might ask is: Is same-sex marriage legal in Australia?

The short answer is yes. But there are a few important legal details, especially for international couples, that are worth understanding.

When Did Same-Sex Marriage Become Legal in Australia?

Same-sex marriage became legal in Australia in December 2017, following a national postal survey.

The Marriage Act 1961 was updated to define marriage as:

“the union of 2 people”

This means:

  • LGBTQ+ couples have equal legal rights to marry as straight couples
  • Marriage laws in Australia apply equally regardless of gender

There are no separate rules or restrictions – your marriage is fully recognised under Australian law.

Can Same-Sex Couples from Overseas Get Married in Australia?

Yes – Australia is a popular destination for LGBTQ+ couples from around the world.

You:

  • do not need to be an Australian citizen
  • do not need residency
  • can marry on a tourist visa

This makes Australia an attractive option for destination weddings.

What Are the Legal Requirements?

To get legally married in Australia, all couples (including LGBTQ+ couples) must:

  1. submit a Notice of Intended Marriage (NOIM) to a marriage celebrant at least 1 month before
  2. provide valid ID (usually passports)
  3. be married by an authorised celebrant
  4. have two witnesses over the age of 18 (I can provide these if you can’t)

The process is the same for all couples – there are no additional steps for same-sex marriages.

Is an Australian Same-Sex Marriage Recognised Overseas?

This depends on your home country.

  • If your country recognises same-sex marriage your marriage is usually recognised
  • If not It may not be legally recognised there

This is especially important for:

  • immigration
  • visa applications
  • legal rights back home

Religious vs Civil Ceremonies

In Australia:

  • civil celebrants (like me) can marry any couple
  • religious institutions are allowed to choose whether they perform same-sex marriages

This means most LGBTQ+ couples choose a civil celebrant for a fully inclusive experience.

Why Australia Is a Popular Choice for LGBTQ+ Weddings

  • strong legal protections
  • inclusive wedding industry (especially in Melbourne and Victoria)
  • iconic wedding destinations like:
    • Daylesford
    • Yarra Valley
    • Melbourne CBD
